Terms of Service
The terms that govern access to and use of Elys.
These Terms of Service (the “Terms”) are an agreement between you and Nature Select Inc. (“Nature Select,” “we,” “us,” or “our”) governing your access to and use of Elys, including our websites, applications, and related services (collectively, the “Services”).
By creating an account, accessing, or using the Services, you agree to these Terms. If you do not agree, do not access or use the Services.
1. Eligibility and Accounts
You must be at least 13 years old to use the Services. If you are under the age of legal majority where you live, you may use the Services only with permission from a parent or legal guardian who agrees to these Terms on your behalf.
You agree to provide accurate account information, keep your login credentials secure, and promptly notify us if you believe your account has been accessed without authorization. You are responsible for activity conducted through your account.
2. The Elys Services
Elys is an AI-powered social product that may let you create and customize a digital avatar, build and manage memories, discover content, communicate, post content, and interact with other people or AI-generated experiences. Available features may vary by version, device, region, or account.
AI-generated content may be inaccurate, incomplete, or unsuitable for your circumstances. It is generated by technology and is not a statement from a human. You should independently evaluate important information and must not rely on the Services for professional medical, legal, financial, or emergency advice.
3. Limited License
Subject to these Terms, Nature Select grants you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable right to use the Services for lawful, non-commercial purposes. Nature Select and its licensors retain all rights in the Services not expressly granted to you.
4. Your Content and Permissions
You retain any rights you have in text, images, audio, profile information, and other material you submit to the Services (“Your Content”). You are responsible for Your Content and must have the rights and permissions necessary to submit it.
You give Nature Select a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, display, and transmit Your Content only as needed to operate, secure, improve, and provide the Services according to your settings and our Privacy Policy. This license ends when Your Content is deleted from our systems, except where retention is reasonably necessary for security, legal compliance, dispute resolution, or backup integrity.
5. Acceptable Use
You may not use the Services to:
- violate applicable law or the rights of another person;
- harass, threaten, exploit, impersonate, defraud, or mislead others;
- submit content that is unlawful, abusive, sexually exploitative, or that promotes violence or self-harm;
- upload malware, interfere with the Services, bypass safeguards, or gain unauthorized access;
- scrape, reverse engineer, or use automated means to access the Services except where applicable law permits it; or
- use another person’s image, voice, identity, or personal information without the necessary permission.
6. Safety and Enforcement
We may investigate suspected violations and may restrict content or suspend or terminate access where reasonably necessary to protect users, the Services, or third parties, or to comply with law. You may stop using the Services at any time and may request account deletion through available account controls or by contacting us.
7. Third-Party Services
The Services may link to or interoperate with third-party services. Their products, content, and practices are governed by their own terms and policies. Nature Select is not responsible for third-party services that it does not control.
8. Ownership and Feedback
The Services, including their software, design, branding, and content supplied by Nature Select, are owned by Nature Select or its licensors and are protected by applicable intellectual property laws. If you send feedback, you allow us to use it without restriction or compensation to you.
9. Service Availability and Changes
We may update, add, remove, or discontinue features and may temporarily interrupt the Services for maintenance, security, or operational reasons. We will use reasonable efforts to provide notice when a material change significantly affects your use of the Services.
10. Disclaimers
To the fullest extent permitted by applicable law, the Services are provided “as is” and “as available.” Nature Select disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services or AI-generated content will always be accurate, secure, uninterrupted, or error-free. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Nature Select and its officers, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or opportunities arising from the Services. Nothing in these Terms excludes liability that cannot lawfully be limited.
12. Changes to These Terms
We may update these Terms as the Services or applicable requirements change. We will post the updated Terms and revise the “Last updated” date. If a change materially affects your rights, we will provide additional notice where reasonably appropriate. Continued use after the updated Terms take effect means you accept them.
